The jury will decide on the facts (who is telling the truth) and applies the law to those facts. In criminal cases, the prosecution has to prove, beyond reasonable doubt, that the defendant is guilty. The defendant does not have to prove innocence. However, it is the jury who will observe the prosecutor and defending lawyer and decide the case. In less serious criminal cases (which comprise over 90% of criminal cases) the case is sent for summary and trial in one of over 400 magistrates courts.

The occupier may not only be a householder. The occupier is anyone with legal responsibility for any premises, be they swimming baths, libraries or residential property. Only people who suffer physical injury or damage to property can claim. The occupier can be liable if the injury is caused indirectly by the dangerous state of the premises. The occupier’s primary responsibility is to anyone who visits the premises as a guest, to do a job, or for some other lawful purpose, such as to carry out a repair.

One of the important points here is that a person can claim from the date that they knew of the injury. So an injury, say from asbestosis, may have started to form many years ago, and over a period of years. However, the claim only has to be made within three years of knowing about the injury.
